Our commitment to our users

The use of Groupe Mutuel’s platforms is governed by the General Terms and Conditions of Use and the Privacy Policy. For the sake of transparency and security, we recommend that you read these charters and review their contents.

  1. Purpose of the terms and conditions of use
    These terms and conditions of use govern access to the Corporate Customer Area that has been made available by Groupe Mutuel Services SA (hereafter, Groupe Mutuel) for its Clients.
     
  2. General description
    Groupe Mutuel has made available to its Clients, in accordance with these terms and conditions, an online portal for reporting claims and managing services that Groupe Mutuel provides to the Client under separate agreements.

    A description of the services available in the Corporate Customer Area can be accessed directly on the website of Groupe Mutuel. Groupe Mutuel reserves the right to modify these services and information at any time, or to add or remove features, depending on how the Corporate Customer Area evolves.

    The Corporate Customer Area is used by the Client's employees or other auxiliaries.
     
  3. Registration, access and authentication

    3.1 Registration
    A registration procedure is provided by Groupe Mutuel on its website https://www.groupemutuel.ch/accessrequest). The Client shall follow the guidelines outlined in the procedure. The Client is responsible for ensuring that the registration procedure is completed in full, on time and correctly, and undertakes to provide accurate data.

    By making a formal request, the Client declares that it has read, understood and accepted these terms and conditions of use.

    During the registration procedure, Groupe Mutuel shall provide means of authentication. Unless otherwise instructed in writing by the Client, Groupe Mutuel will send these means of authentication to the last address communicated by the Client. It is the Client's responsibility to ensure that it is able to receive the means of authentication and, subsequently, to use them.

    To complete its registration, the Client shall enter the authentication data on the login page in order to receive, according to its choice, the double authentication code by SMS text message or email. The Client shall change the first personal password without delay. The user is free to choose the password. Groupe Mutuel recommends changing the password regularly. For security reasons, the password must not make it possible to identify the Client.

    3.2 Access and authentification
    Access by the Client to the Corporate Customer Area requires authentication as part of a multi-level connection procedure, in particular using the Client's user identification, personal password and double authentication code.

    Anyone who provides Groupe Mutuel with valid authentication is considered to be authorised to use the Corporate Customer Area.

    Groupe Mutuel may add to or modify the authentication procedure at any time. In particular, it may at any time introduce additional security levels or other security levels in line with the current state of the art.
     
  4. Authorised persons
    The Client takes all necessary measures to prevent unauthorised persons from accessing the Corporate Customer Area. It shall identify by name the persons to whom it grants access to the Corporate Customer Area and shall indicate all the required information concerning these persons, including their level of right of access (Admin, Super User, User).

    The Client acknowledges that the level of access rights it grants to Admins is such as to represent it legitimately in the context of the features provided in the Corporate Customer Area. Groupe Mutuel may consider, regardless of the Client's situation, its entries in the commercial register and without further verification of the nature of the rightful claimant, that the Admin appointed by the Client is authorised to act on the Client's behalf (apparent power of attorney).

    In addition, it is the Client's responsibility to regularly update the list of persons who have access to the Corporate Customer Area. Groupe Mutuel undertakes, at the first written or electronic request of the Client, to withdraw as quickly as possible any access granted to a person whose access the Client no longer authorises.

    The end of the contractual relationship between Groupe Mutuel and the Client means that all access to the Corporate Customer Area will be cancelled, subject to the three-month period for saving documents (Art. 10).
     
  5. Client obligations

    5.1 Technical requirements
    The Client is responsible for providing the required technical infrastructure (including hardware and software) for access to the Corporate Customer Area.  This requires a terminal with an Internet connection and a current Internet browser. Other system requirements may be made known to the Client in the Corporate Customer Area. The Client acknowledges that technical requirements may change at any time.

    5.2 Due diligence requirements
    The Client is responsible to Groupe Mutuel for any use of its access by itself and its users, as well as for the content of the information it has its users transmit or Groupe Mutuel process.

    The Client must never disclose or transmit authentication tools to unauthorised persons (neither verbally, nor in writing, nor in electronic form). Any recording or unprotected electronic backup of authentication instruments is prohibited. The Client shall regularly change its password. For security reasons, the Client shall choose passwords that cannot be used to identify it personally.

    If the Client has reason to believe that the personal password has come to the knowledge of an unauthorised third party or that the device used to access the Corporate Customer Area is in the hands of a third party, the Client must change it immediately. In the case of user identification, the Client must immediately inform Groupe Mutuel so that it can take all necessary measures as soon as possible.

    The Client shall ensure that unauthorised persons cannot manipulate its electronic devices (e.g. computer, notebook/laptop, mobile phone, tablet, etc.) or its computer programs. In particular, the Client shall take all necessary precautions to prevent damage to its technical equipment and the software required. In addition, the Client shall regularly update the security of its operating system, all its programmes and applications. Groupe Mutuel declines all responsibility in the event of non-compliance.

    The Client shall keep itself up-to-date on the required security precautions and reduce the security risks arising from use of the Internet by using appropriate security measures (in particular anti-virus software and firewalls).

    The Client shall bear all risks and damages resulting from the awareness by a third party of the means of authentication allowing access to the Corporate Customer Area, and from the use, even misuse, of these means.
     
  6. Data protection
    Data protection and data security are a priority for Groupe Mutuel. With regard to the collection, processing, communication and use of its Clients' personal data, Groupe Mutuel is subject to compliance with the legal framework, in particular the Federal Law on Health Insurance, the Ordinance on Health Insurance as well as Federal Law on Data Protection (LPD/DSG).

    Groupe Mutuel shall inform the Client in advance of any processing of data for other purposes via the Corporate Customer Area. In accordance with the legal provisions on data protection, the Client may accept or refuse certain types of data processing.

    The Client undertakes to comply with the Law on Data Protection (LPD/DSG). The Client undertakes to ensure that the data sent to the Corporate Customer Area will be used only to report a claim or to administer certain services that Groupe Mutuel provides to the Client under separate agreements.
     
  7. Confidentiality
    Groupe Mutuel is subject to legal obligations regarding confidentiality, in particular medical confidentiality and data protection. It takes technical and organisational measures to secure the data it makes available to its insured persons. To protect access to data, the Client undertakes to keep confidential its user name, password and the code from the authentication system and to protect them from fraudulent use.
     
  8. Liability
    Groupe Mutuel is not liable for any direct or indirect damage within the limits of the legal provisions. Furthermore, Groupe Mutuel excludes all liability for damage resulting from incorrect or abusive use of the Corporate Customer Area by the Client or by persons to whom the Client has granted access to the Corporate Customer Area.

    Liability is also excluded for damage suffered in particular in the following cases:
    - in the event of faulty data transmission; for any damage suffered by the Client as a result of transmission errors, technical faults, blockages, overloads, interruptions, malfunctions or unlawful interference with the Internet or telephone network, or with telecommunications installations, or as a result of inadequacies on the part of the operators of these installations and networks.
    - if the Corporate Customer Area is unavailable;
    - in the event of manipulation by third parties;
    - in the event of technical incidents;
    - any liability for the accuracy and completeness of data transmitted and displayed electronically;
    - for documents that have not been retrieved within three months of the request for withdrawal.
     
  9. Changes to the terms and conditions of use
    Groupe Mutuel reserves the right to amend at any time these terms and conditions of use. These modifications will be communicated to the Client via the Corporate Customer Area or any other means deemed appropriate by Groupe Mutuel and will be considered as approved, unless the Client gives notice to the contrary within one month.

    These terms and conditions of use may be supplemented by technical appendices or practical recommendations. The appendices and practical recommendations form an integral part of these terms and conditions of use. They may be amended, supplemented or withdrawn at any time by Groupe Mutuel.
     
  10. Withdrawal of access and consequences
    In principle, access to the Corporate Customer Area is not limited in time, provided that the Client has one or more insurance policies with a company belonging to Groupe Mutuel. However, the Client may request that its access be closed. Access will then be withdrawn by Groupe Mutuel.

    The Client will have a period of three months to save its documents, after which the withdrawal of access to the Corporate Customer Area will be definitive.

    When the access to the Corporate Customer Area has been opened for several insurance coverages (accident, loss of earnings, LPP/BVG insurance contracts), if the contractual relationship undergoes a modification, Groupe Mutuel reserves the right to adapt the access to the Corporate Customer Area accordingly without further notification.

    Groupe Mutuel reserves the right to suspend at any time, without prior notice and without giving reasons, temporarily or permanently, the access of the Client or certain users to the Corporate Customer Area without obligation to pay compensation, insofar as this appears appropriate for objectively justified reasons, in particular in the event of a breach of one of its provisions, in the event of abuse of any kind, or in the event of repeated non-compliance with practical recommendations. It will inform the Client of any such suspension as soon as possible.
     
  11. Intellectual property
    All rights relating to the elements of the Corporate Customer Area (copyright, patent rights, design rights, etc.) continue to be held by Groupe Mutuel or authorised third parties.

    The elements may only be used by the Client in the context of the Corporate Customer Area. Access to and use of the "Corporate Customer Area" does not give any right to use the items outside of this framework.
     
  12. Language
    These terms and conditions are drawn up in French. In the event of any discrepancy, the French version shall prevail. This is without prejudice to any translations of the conditions into another language.
     
  13. Jurisdiction and applicable law
    These terms and conditions of use and all questions, claims or disputes arising from them or which may arise as a result of them, in particular concerning their creation, validity and interpretation, are subject to Swiss substantive law; Martigny is the exclusive place of jurisdiction.

    Groupe Mutuel Services SA
  1. Purpose
    This Privacy Policy refers to the processing of data in connection with the platforms available at www.groupemutuel.ch and all other platforms of Groupe Mutuel Services SA, Rue des Cèdres 5, 1919 Martigny, Switzerland (Groupe Mutuel). The use of these platforms is governed by the general terms and conditions of use (CGU).

    This Privacy Policy does not refer to third party websites, nor to the processing of the personal data that you have transmitted to Groupe Mutuel or that Groupe Mutuel has collected from you other than through the platforms.

    Groupe Mutuel reserves the right, at its sole discretion, to modify this Privacy Policy at any time and without notice. In this case, it will be published on the relevant platforms and replace the former one. By using the platforms after any changes, you expressly accept the new version of the Privacy Policy.

    By accessing and using the platforms, you expressly authorise Groupe Mutuel to process your personal data transmitted in this way, in accordance with this Privacy Policy.
  2. Data processing regulations
    The principles for the processing of data by Groupe Mutuel in relation to compulsory health insurance (LAMal/KVG) are defined in the Data Processing Regulations. The user therefore acknowledges that the Groupe Mutuel Data Processing Regulations also refer to the platforms and form an integral part of this document insofar as the data processed by the platforms is related to compulsory health insurance (LAMal/KVG).
     
  3. Types of data collected via the platforms
    Groupe Mutuel collects data related to your access and use of its platforms. In particular, Groupe Mutuel may collect your personal data by using or not using third party services (including platforms such as Google, Microsoft, Campaign Monitor, Facebook and Usafe). Your personal data consists of any information that identifies you or allows you to be identified, even indirectly, by reference to other information, including a personal identification number, which concerns your name, address, billing information, e-mail address, IP address, geolocation or any other information that can be used to identify or contact you when accessing and using the platforms.
     
  4. Organisational and technical measures
    As a user of the platforms, you agree that data relating to your health, including the benefits’ statements, may be made available by Groupe Mutuel via a secure Internet connection. However, you are aware of the potential risk that this data may be intercepted and accessed by unauthorised third parties. Following legal processing of the data, Groupe Mutuel does not assume responsibility for this risk to the extent permitted by law, subject to gross negligence.

    Groupe Mutuel processes your personal data in accordance with Swiss data protection legislation and takes all necessary security measures to prevent unauthorised access, disclosure, modification or destruction of your data in general and personal data in particular. The provisions of foreign laws or regulations are reserved.
     
  5. Data processing location
    Subject to paragraph 9) below, your personal data is stored in a data centre and processed at Groupe Mutuel headquarters in Switzerland.
     
  6. Storage period
    Subject to any legal obligations for storage, personal data is kept by Groupe Mutuel for as long as necessary to fulfil the purposes for which the data was collected.
     
  7. Purpose of data processing
    If you are a customer of Groupe Mutuel, or if you transmit personal data via the platforms in order to become a customer, Groupe Mutuel may use the data transmitted as part of the establishment and/or management of this contractual relationship. 

    a. Compulsory social insurance (compulsory health insurance – AOS/OKP, occupational pension benefits and accident insurance against workplace accidents)
    Only the personal data necessary for the performance of specific tasks falling within the scope of the law shall be collected and processed. Groupe Mutuel may use your personal data, including sensitive data necessary to perform the tasks provided for by law. However, the data cannot be processed for the purpose of commercial prospecting.

    b. Other insurance
    Personal data is collected in order to allow Groupe Mutuel to operate its platforms, to provide specific offers according to customer needs and in line with the market and/or to provide services related to the platforms.

    Groupe Mutuel may use your personal data, including contact information and other information sent via the platforms for commercial and advertising purposes, in particular for internal tests and statistics, to improve its products and services and to send you information and offers relating to the products and services of Groupe Mutuel and/or its partners, such as brochures, newsletters and other advertising messages, if you give your consent at the time of transmission of such data. You can withdraw your consent at any time by visiting our contact page.
     
  8. Data accuracy
    In the event of changes to an address (postal or electronic), bank account or other personal data, you undertake to notify Groupe Mutuel via its platforms. You may also request that incorrect data be corrected. Groupe Mutuel shall take the appropriate measures to correct inaccurate or incomplete data with regard to the purposes for which the data is processed.
     
  9. Disclosure to third parties
    Groupe Mutuel may transfer your personal data to third party service providers designated to support Groupe Mutuel in its business, in particular in the context of commercial prospecting. Third party service providers may be located and process your personal data in Switzerland or in the European Union.

    Groupe Mutuel may also transfer your personal data to third party service providers abroad, in particular in the European Union and the United States. Not all of these countries offer a level of data protection equivalent to that in Switzerland. In such a case, you expressly authorise Groupe Mutuel to communicate your personal data to such service providers.

    If you access the platforms using telecommunications' services, all communication-related data (e.g. Internet Protocol address) or usage data (e.g. data concerning the start and duration of usage) may be processed by these telecommunications' services in accordance with legislation and their own terms and conditions of usage and privacy policy.
     
  10. Third party services
    The processing of personal data by third party service providers is subject to the privacy policies of these third party service providers.

    a. Access to third party services’ accounts
    Your access to and use of the platforms may provide third party service providers with access to your personal data. These features are not activated automatically but require your specific authorisation. For example, platforms can connect and transmit personal data to social networks such as Facebook, Twitter or LinkedIn, if you use certain features (e.g. “social plug-ins”). Since these social networks use your data, particularly for tracking and advertising purposes, Groupe Mutuel recommends that you consult the social networks’ data use policies and take measures to increase the confidentiality of your data.

    b. Registration and authentication
    Platforms may allow you to register and/or authenticate to use certain features, using third party services. For example, platforms can allow you to register and/or authenticate via your personal Facebook profile. In this case, personal data is exchanged between Facebook and the relevant platforms. The personal data collected by Groupe Mutuel is processed in accordance with this privacy policy.

    c. Interactions based on geolocation
    Platforms can collect, use and share your geolocation data to provide you with services based on it. Most browsers and electronic devices provide tools to deactivate this default feature. If you have given your consent, your geolocation data can be tracked by Groupe Mutuel’s platforms. Groupe Mutuel recommends that you configure your mobile device correctly to accept or reject geolocation.

    d. Third party web pages
    Platforms may contain links to web pages that are not maintained by Groupe Mutuel and are not related to Groupe Mutuel (hereafter referred to as "third party web pages"). The use of such links is at the user's own risk. Groupe Mutuel is neither competent nor responsible for monitoring or assessing the content on these third party web pages. The contents of third party web pages do not reflect the opinion of Groupe Mutuel. Therefore, Groupe Mutuel cannot be held responsible for the content of third party websites, particularly with regard to their accuracy and comprehensiveness.

    e. Optimisation
    As a user of the platforms, you agree that, for optimising the platforms and for statistical purposes, Groupe Mutuel may, when using the platforms, provide, enter, process and use data anonymously. The data does not allow you to be identified and is simply intended to provide general information about usage behaviour (e.g. how often platforms are used). This data is used for anonymous statistical evaluations and to improve the platforms.
  11. Cookies and other tracking technologies
    a. General information
    In order to improve the use and features of the platforms, Groupe Mutuel uses different types of “cookies” (small text files in which an identification number is integrated and may be stored on your electronic device) or other indicators such as “pixel tags”, some of which may automatically record and transmit personal data to the platforms. They allow Groupe Mutuel to improve customer services and recognise previous visitors to its platforms. When you access and use the platforms, a cookie identifies your electronic device. Pixel tags serve a similar purpose, but do not install files directly on your electronic device. Groupe Mutuel also uses cookies to measure and monitor traffic and use of the platforms and their features.

    If you do not want cookies to be stored on your electronic device, you must configure your Internet browser or electronic device to block cookies before using the platforms. If you do not do so, you consent to the collection and processing of data as provided for in this Privacy Policy, including, where applicable, personal data collected in this way. However, some cookies are essential for the proper functioning of the platforms and the use of the platforms or some of their features may be altered, limited or not work when all of the cookies are blocked. Groupe Mutuel recommends accepting cookies and not deleting them in order to improve the user's browsing experience and improve platforms.

    b. Types of cookies and pixel tags used
    There are four main reasons why cookies can be stored on your electronic device when you access and use the platforms:
    - for the execution and proper functioning of the platforms;
    - to collect anonymous data, in order to improve the platforms;
    - to save your preferences and make the platforms more user-friendly;
    - to track your online behaviour, in order to customise the content displayed on the platforms you visit.

    Cookies in the latter category may be placed by third parties, since Groupe Mutuel has no control over the placing of such cookies by third parties when you visit their websites. However, Groupe Mutuel may use cookies in this category to recognise you when you visit third party websites and to display advertising for its products and services, in particular.

    The cookies used by the platforms are stored on your electronic device by Groupe Mutuel or by third parties, such as Google.

    Some cookies are stored on your electronic device only for the duration of your access and use of the platforms, while others will remain for a specific or, more rarely, unspecified period.

  12. Provisions specific to platforms
    a. Premium calculator
    In the first stage, the offer and your data are not saved in our databases but are stored in the browser's memory. You can save your calculations and resume your session at any time within 30 days. During this period, your data is stored in our databases and on our server. Once the 30-day period has expired, your data will be deleted from the databases if you have not taken out insurance or initiated other contacts with Groupe Mutuel. In addition, this Privacy Policy refers to the processing of data in connection with the use of this platform and the conclusion of an insurance contract.

    b. Form and contact
    Some Groupe Mutuel platforms may offer the possibility of contacting Groupe Mutuel by email, via contact forms or by other means such as the premium calculator, chats and telecommunications software.

    The confidential personal data that you send to Groupe Mutuel via the forms on the platforms are transmitted in an encrypted form in accordance with the latest technology and cannot be accessed by third parties. The data that you enter via Internet platforms is used in particular for the execution of the contract as well as for the processing of your requests and, where applicable, for marketing purposes within Groupe Mutuel.

    By entering your data in the premium calculator, you agree that Groupe Mutuel may contact you by telephone or another channel when submitting an offer.

    c.Recruitment platform
    Your application will be examined solely on the basis of your professional skills in relation to the profiles sought or the position for which you are applying. The various selection stages are documented and guarantee the quality of the hiring process. Groupe Mutuel will keep you regularly informed of the progress of the procedure and applies principles of non-discrimination in terms of recruitment.

    Your personal data is only accessible to Groupe Mutuel's Human Resources Department and to the employees responsible for your recruitment.

    Your personal data must be accurate, truthful and up-to-date and not incomplete, misleading or deceptive. Groupe Mutuel would like to remind you that any inaccurate information may result in the termination of your employment contract. Groupe Mutuel therefore reserves the right to delete your profile and/or attached documents if your application does not correspond to the purpose of the application procedure.

    Your documents, your employment and education information, as well as your consent, will be deleted after six months following your application if your application has not resulted in an employment contract. With your consent, Groupe Mutuel will keep your data in our database for a longer period of time in order to be able to offer you another position. 

    It should be noted that communications made via methods that use the Internet, and therefore a public network over which Groupe Mutuel has no control, are liable to be intercepted, altered or lost. Groupe Mutuel does not accept any liability in this respect.
     
  13. The “Voice of the Customer”
    The “Voice of the Customer” programme is an initiative of Groupe Mutuel aimed at further including customers interested in giving their opinion. Therefore, customers can participate in improving existing processes and products and help develop new products and services. The purpose is to ensure that services are tailored to the needs of customers as closely as possible. As a customer, you have the opportunity to give your opinion on various projects and topics. For each study carried out, a random selection is made according to the criteria sought among the customers who are part of the programme. When you inform Groupe Mutuel of your wish to participate in a specific survey, you will receive an overview of the project or topic on which your opinion is needed. Participation in the “Voice of the Customer” programme is always on a voluntary basis. You may therefore unsubscribe at any time by sending an email to voiceofcustomer@groupemutuel.ch or by clicking on the link “unsubscribe” in the electronic media sent to you. 

    When you sign up to the programme, Groupe Mutuel collects the following data:
    - Gender
    - Name
    - First name
    - Full address (street, no., town and postcode)
    - Date of birth
    - Telephone number
    - Email
    - Preferred language for surveys

    This data will be used to contact you.

    At the end of this first contact stage, you will have the opportunity to complete your data by filling in the registration form.

    The following information is included in the registration form:
    - Preferred language for oral feedback
    - Type of surveys you wish to participate in
    - Contacts with Groupe Mutuel
    - Preferred contact method (email, mobile phone, landline)
    - Nationality
    - Duration of residence in Switzerland
    - Canton of residence
    - Bilingual German-French
    - Composition of household
    - Gross monthly income
    - Professional status
    - Occupational sector
    - How long have you been a customer with Groupe Mutuel
    - Type of insurance taken out
    - Basic insurance model
    - Type of supplemental insurance
    - Chosen deductible for basic insurance
    - Level of knowledge in the insurance field
    - Management of insurance
    - Frequency of use of the online Customer Area
    - Overall satisfaction

    All the questions in this form are optional and the information will be used to invite you to the surveys, focus groups or events that are most suited to you. The personal data you make available to Groupe Mutuel is only processed as part of the “Voice of the Customer” programme.


    Furthermore, the answers and reviews you provide to Groupe Mutuel in these surveys are anonymised before they are recorded. This data is valuable for Groupe Mutuel to be able to develop specific projects but also to better adjust insurance products and services.

    If, for a particular study, your answers were not to be anonymised, you would be informed of this beforehand when being invited to participate.

    As part of community management and to avoid contacting you too frequently, the history of your participation in the various studies is also kept.

    Groupe Mutuel may share your personal data with third-party service providers appointed to support its business. In such cases, Groupe Mutuel will ensure that third-party service providers comply with the provisions relating to the protection of your data and information security to the same extent as Groupe Mutuel.

    Concerning the data collected as part of the programme, you have the following rights.
    - You may request information on the personal data that was recorded.
    - You may request that your personal data be modified, completed, blocked or deleted.

  14. Right of access
    You have the right to access your personal data, to have it corrected, to have your data deleted within the limits of the applicable legal provisions, to limit the processing of your data, to request that it be transferred, to withdraw your consent to the processing of personal data, subject in particular to the processing required for the performance of a contract and to refer the matter to the competent supervisory authority.

  16. Applicable law and jurisdiction
    This document and the use of the platforms are governed by Swiss law. Any dispute relating to or arising out of the platforms or their use shall be submitted to the exclusive jurisdiction of the competent courts in the district of Martigny, subject to any binding jurisdiction.
